I took the easiest up date of overwriting the admin folder and the index file.

ever since I have a warning message in amind pages stating the following

Warning: Server Setup non-Apache

Never seen this before I have no idea exactly what it means
I checked the gsconfig and that entry wasn't in there,

so I added it and unchecked it and that worked.

That is why we provide a gsconfig temp file with the install.
Also check the rleawse notes when updating it covers this stuff usually.

Also let us know what your server is so we know how this is working out.

The message is to alert you that using a non apache server is not by default secured. Your site is hackable if it does not protect the xml files, which is done via htaccess files for apache.
I had a look at my control Panel for the web space and it is running Apache version 2.2.22
What does health check say under apache check?
Apache Installed OK
hmm so health check says apache ok, but you got Warning: Server Setup non-Apache ?

This is what mine looks like in 3.2
"Apache web server................................Apache - OK"

What does this say exactly on yours?

That has nothing to do with what php returns to us.
